Party wall agreements are common in London thanks to the density of the housing stock. But party wall disputes can arise anywhere, and it’s vital that you head off disagreements before they risk derailing your plans.
There’s been a marked increase in renovation work across Essex, so it makes sense to start your project with a party wall agreement in place. As a RICS party wall surveyor and FPWS party wall surveyor in Chelmsford, we’re here to help your renovation run smoothly and ensure everyone is treated fairly.
What is a party wall?
A party wall is any boundary wall shared by two properties belonging to different owners. Examples include:
- Terraced properties
- Semi-detached homes
- Garden walls and other boundary structures

Why you might need a party wall agreement in Chelmsford
If your renovation plans involve a party wall or its foundations, the work may be subject to the Party Wall etc. Act 1996. While the Act doesn’t prevent you from carrying out your planned work, it’s a good idea to follow the framework to the letter, allowing you to handle any issues right at the start of the process.
If you’re considering a loft conversion, basement excavation or rear extension, the chances are you’ll need to put a party wall agreement in place. A party wall surveyor in Chelmsford can help you reach an agreement if you’re struggling to find common ground on your own.
The Party Wall etc. Act 1996: What you need to know
It’s essential to note that the Act won’t stop your renovation work. However, it does protect your neighbour’s property if any damage occurs as a result and can protect you against spurious claims of damage.
Although not a requirement, it is customary to inspect your neighbour’s before and in some cases after any works. This survey must be carried out by your party wall surveyor in Essex, who then writes an ‘award’. This legally binding document states:
- The work to be done
- The project timescale
- Who pays for what
Although you don’t need a party wall agreement to get planning permission, you can’t legally start work on your property without meeting your statutory obligations.
When do you need to serve a party wall notice?
A party wall notice is the legal document that informs your neighbour of your intention to start work. This gives them time to consent or dissent your plans and to settle any disputes.
Depending on your planned renovations, you’ll need to serve one of the following notices:
- Line of junction notice: Intention to build on, or up to, the boundary line, e.g. a garden wall. Must be served at least one month before work begins.
- Notice of adjacent excavation: Intention to excavate within 3-6m of a neighbouring property, including excavation depth. Must be served at least one month before work begins.
- Party structure notice: Intention to work on a shared wall or structure, such as inserting new beams or removing a chimney breast. Must be served at least two months before work begins.
Once notice is served and consented to, you’ll have up to a year to start your planned work.
What happens if you don’t serve notice?
It’s critical not to skip this legal step. Doing so can result in project delays and disputes with your neighbours. You could risk having to pay for damage, even if it wasn’t your responsibility, and your neighbours could get an injunction to stop further work, increasing your costs.
With increased planning scrutiny across Essex boroughs, it makes sense to ensure your project is legally compliant. Contact us today for party wall advice in Essex, or check out our knowledge hub for more helpful tips.
